Terms of Service

1. Operator

Apiverket.se ("the Service") is operated by Cuon Aktiebolag, org.nr 559459-3526, registered in Sweden. By accessing or using the Service, you agree to these Terms of Service.

2. Description of Service

Apiverket.se provides a unified REST API that aggregates publicly available data from Swedish government agencies. We act as a pass-through and do not modify the underlying data.

3. API Keys & Authentication

• You must use a valid API key to access the Service.
• API keys are personal and must not be shared or published in client-side code.
• You are responsible for all activity under your API key.
• We reserve the right to revoke keys that violate these terms.
• Test keys (sk_test_*) return sandbox data and are subject to reduced rate limits.

4. License & Commercial Use

• Free tier: Grants a non-exclusive, non-transferable license for personal, non-commercial use including evaluation, prototyping, and educational projects.
• Paid tiers (Starter, Pro, Business, Enterprise): Grant a non-exclusive, non-transferable license for both personal and commercial use, including integrating API data into commercial applications, SaaS products, internal business tools, and client projects.
• All tiers: You may not resell raw API access or create a competing API aggregation service. You retain full ownership of any applications you build using the API.
• The underlying government data is subject to each originating agency's open data license (typically free for commercial and non-commercial reuse).

5. Acceptable Use

You agree not to:

• Exceed the rate limits of your subscription tier.
• Attempt to circumvent rate limiting, authentication, or security measures.
• Use the Service for any unlawful purpose or in violation of Swedish law.
• Resell API access or create a competing service using our infrastructure.
• Scrape or bulk-download data in ways that degrade service for other users.
• Store or redistribute government data in ways that violate the originating agency's license terms.

6. Data Protection Compliance

Certain API endpoints return publicly available government data that may include personal data as defined under the General Data Protection Regulation (GDPR). By using the Service, you acknowledge and agree that:

• You are solely responsible for determining whether your processing of personal data obtained through the API is lawful, including identifying an appropriate legal basis under GDPR Art. 6.
• You must comply with all applicable data protection laws, including the GDPR and the Swedish Data Protection Act (dataskyddslagen), when storing, processing, or sharing personal data retrieved from our API.
• You are responsible for responding to data subject requests (access, erasure, rectification) relating to personal data you have obtained and stored.
• If your use of the data requires a Data Protection Impact Assessment (DPIA) under GDPR Art. 35, it is your responsibility to carry one out.

7. Rate Limits & Quotas

Each tier has specific rate limits and daily quotas as described on our pricing page. Exceeding these limits will result in HTTP 429 responses. Persistent abuse may result in key suspension.

8. Data Accuracy & Availability

We aggregate data from third-party government sources and provide it "as-is". We make no warranty regarding:

• The accuracy, completeness, or timeliness of data from upstream agencies.
• Continuous availability of the Service (upstream APIs may be temporarily unavailable).
• Suitability of the data for any particular purpose.

Cached data may be up to the TTL (time-to-live) period behind the source. Real-time endpoints (trains, power grid) are cached for minutes; static data for longer periods.

9. Pricing & Payment

• The Free tier is available at no cost with the published limits.
• Paid tiers (Starter, Pro, Business, Enterprise) are billed monthly in SEK via Stripe.
• Prices may change with 30 days notice to active subscribers.
• Refunds are handled on a case-by-case basis.

10. Intellectual Property

The Apiverket.se API, documentation, and website are owned by Cuon Aktiebolag. You retain full ownership of any applications you build using the API.

11. Limitation of Liability

To the maximum extent permitted by Swedish law, Cuon Aktiebolag shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees you paid in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Cuon Aktiebolag from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Termination

Either party may terminate at any time. We may suspend or terminate your access immediately if you violate these terms. Upon termination, your API keys will be deactivated. Sections on liability, indemnification, and governing law survive termination.

14. Governing Law & Disputes

These terms are governed by the laws of Sweden. Any disputes shall be resolved by the courts of Stockholm, Sweden.

15. Changes

We may update these terms with 30 days notice. Continued use after the notice period constitutes acceptance of the updated terms.
